As an Army Captain I was Command Judge Advocate of Military Police for the Persian Gulf war. I ended up having to threaten to testify against my task force Commanding General as to his personal responsibility for the murder of innocent refugees (it had already happened on his watch). At the time I was tasked to handle the legalities of theater refugee operations. This was after I had handled the prisoners of war mission as MP Brigade S3 action officer, task force commander, convoy commander and legal officer for VII Corps.
After completing the EPW mission and the cease fire ending Desert Storm, I was given the refugee mission. The Task force commander BG Blackwell (also 2nd Armored Calvary Regimental Commander) had just returned from being briefed by the NCA (Pres,VP,Sec Def, Sec State). What the National Command Authority told him and my technical Chain of Command TJAG, was to return the refugees to Iraq and wean these refugees off dependency on Coalition forces. In the face of water shortages the refugees who had been involuntarily moved from Saudi Arabia back into Iraq became restive and ran towards the water truck when the were shot down. Murder, refoulement and the NCA based conspiracy to deny protections of the Geneva Convention (and UCMJ) were grave breeches of the Geneva Conventions. I counseled repression of War Crimes as the law requires.
Needless to say my standing up to a Commanding General and refusing to back down and disagreeing with my superior Judge Advocates caused incredible consternation for my superiors. Generals Franks and Swartzkopf flew into the Iraqi Rafa refugee camp to resolve the "problem". In consult with the NCA I'm sure, they appropriately decided to follow my advice. As a result the @40,000 refugees were processed and resettled consistent with the Geneva Conventions. My boss who became Judge Advocate General of the Army, whose head I had gone over and whose legal advice I disagreed with to threaten BG Blackwell wrote in my Officer Efficiency Report that "on occasion Cpt Kerian's efficiency is injured by an excess of zeal". He gave me a 2nd out of 10 block rating which with the excess of zeal comment assured I was passed over for Major.
I appealed and won some whistle blower technical protection, the negative language was taken out of my OER, but I was still passed over in reprisal for whistle blowing. I left the Army and active duty. A year or two later while attending the Command and General Staff College I was recruited into the Air National Guard. Throughout these many intervening years I appealed the reprisals and marginalization to which I was subject as a whistle blower all the way to the U.S. Supreme Court. I was denied certiorari (discretionary review) by the U.S. Supreme Court. I was threatened and followed, my mail was stolen my briefs were inexplicably lost (stolen) out of the Federal Court house and the courts were ineffectual in supporting the law.
During this period @1993 - 2010 I served in the Air National Guard. I was promoted to Lt Col and became the SJA (General Counsel) of the NYANG 106 Rescue Wing of Perfect Storm and Space Shuttle rescue fame. This was a very active Special Ops and Air Combat Command asset. At the same time I was also full time Supervisory Political Asylum Officer for the U.S. Justice Dept. occasionally stationed abroad and attending War College. In Air War College I wrote the attached a whistle blowing War College paper. In punishment for using this my Air War College Paper to report up my chains of command ongoing U.S. war crimes and bad faith treaty noncompliance, I was not only dis-enrolled from AWC (after passing every test) and thus denied promotion to 06; I was selectively non-retained out of the ANG and Air Force (forced to retire after 32 years).
I had a great career 10 years enlisted 22 as an officer; but there is no tolerance for the truth or the law in the military. Many U.S. military Judge Advocates facilitate illegality rather than repress war crimes! Our Citizens and service members are lied to and enslaved to ignorance, imperial wars and racist agendas.
I have been admitted to practice in 4 U.S. States and the U.S. Supreme Court. I have taught law and legal subjects at 6 different Colleges and Universities including the Federal Law Enforcement Training Academy. I have practiced International Law in Germany as a civilian. I have been a Prosecutor, Chief of Criminal Law, Assistant United States Attorney. I applied International and U.S. law to refugee populations from throughout the world as a Justice and Homeland Security supervisory Political Officer. My efficiency reports consistently rated me as outstanding. The War College Paper is the truth and right on the law.
